INFORMATION NOTE AND AGREEMENT - REGARDING THE PROTECTION OF PERSONAL DATA

Începând cu data de 25.05.2018, devine aplicabil Regulamentul general al Uniunii Europene 2016/679. Privind protecția persoanelor fizice în ceea ce privește prelucrarea datelor cu caracter personal și privind libera circulație a acestor date (denumit în continuare Regulament).

LCM ONLINE NETWORK SRL (denumit în continuare LCM Center), prin reprezentantul legal IONESCU ADRIAN FLORIN, vă aduce la cunoștință pe această cale următoarele informații esențiale privitoare la drepturile pe care le aveți în conformitate cu dispozițiile Regulamentului.

Scopul principal al Regulamentului consta in asigurarea unui nivel crescut de protectie a datelor cu caracter personal precum si crearea unui cadru de incredere astfel incat dumneavoastra sa aveti posibilitatea de a detine controlul asupra propriilor date.

Temeiul pentru care colectam, administram si detinem datele dumneavoastra personale este in primul rand consimtamantul dumneavoastra, acordat cu prilejul incheierii conventiei/contractului de cesiune de drepturi de autor etc. Totodata, temeiul este si unul legal/contractual ce a luat nastere intre dumneavoastra si societatea noastra, dar si un temei legitim, necesar si indispensabil desfasurarii activitatii economice a societatii cat si a dumneavoastra.

COLECTAREA DATELOR CU CARACTER PERSONAL

CE DATE CU CARACTER PERSONAL PRELUCRAM? Datele personale pe care le prelucram sunt, in principal si dupa caz, datele ale cartilor de identiate sau alte documente de identificare (nume, prenume, CNP, seria si nr cartii de identitate, domiciliul sau resedinta, nationalitatea, tara de origine) adresa postala pentru comunicare, numarul de telefon , adresa de e-mail, cont bancar, imagini foto/video, in vederea furnizarii serviciilor noastre.
IN CE SCOP COLECTAM DATELE DUMNEAVOASTRA CU CARACTER PERSONAL? Datele cu caracter personal sunt colectate: in scopul furnizarii si livrarii de informatii si servicii solicitate de dumneavoastra, in vederea executarii in bune conditii a obligatiilor asumate de LCM. Fara a ne afla in posesia acestor date cu caracter personal ne aflam in imposibilitatea de a incheia relatii de colaborare cu dumneavoastra si in conseciinta nu veti beneficia de serviciile noastre. De asemenea, datele dumneavoastra cu caracter personal vor fi prelucrate si in vederea indeplinirii unor obligatii ce rezulta din dispozitii legale.

DREPTURILE PE CARE LE AVEM IN BAZA REGULAMENTULUI

- the right to have access to your data: you may request that the categories of personal data that are processed be communicated to you, the purpose for which the processing takes place, the recipients to whom they have been or will be communicated, the period for which the criteria used to determine this period will be stored or, if this is not possible; the existence of an automated decision-making process including the creation of profiles;

- the right to request the rectification of data: in the event that there are errors in the data being processed, you have the possibility to request their correction; If the data is incomplete, you can request that it be completed. The rectification will be communicated to each of the recipients to whom the data were transmitted, unless this proves impossible or involves disproportionate effort;

- the right to request the restriction of data processing: you have the right to request the restriction of data processing in the following situations: if you have challenged the accuracy of the data, for a period that allows us to verify the accuracy of the data; if the processing is illegal and you object to the deletion of personal data, instead requesting a restriction on their use; if the controller no longer needs the personal data for the purpose of processing, but you request it for the establishment, exercise or defense of a right in court; if you objected to the processing for the time period in which it is verified that the legitimate rights of the operator prevail over your rights;

DREPTURILE PE CARE LE AVEM IN BAZA REGULAMENTULUI

- the right to request the deletion of data: you may request the deletion of the processed data, if the data is no longer necessary for the purposes for which it was collected or processed, if you have withdrawn your consent and there is no other legal basis for processing; if you object to the processing and there are no legitimate reasons prevailing in respect of the processing; personal data has been processed illegally; personal data must be deleted in order to comply with a legal obligation; personal data have been collected in connection with the provision of information society services;
- the right to request the transfer of data (on data portability): you can request the transfer of your data to another operator if the processing is based on your consent and the processing is automatic;
- the right to object to the processing: you have the right to object to the processing of your data if they concern direct marketing. At the same time, you may object to the processing, unless the controller demonstrates that he has legitimate reasons justifying the processing and that it prevails over your interests, rights and freedoms or that the purpose is to establish, exercise or defend a right in court;
– dreptul de a nu face obiectul unei decizii bazate exclusiv pe prelucrarea automatizată a datelor. Dumneavoastră nu veți face obiectul unei decizii bazate exclusiv pe prelucrarea automatizată a datelor.
În situația în care consideraţi că v-au fost încălcate drepturile, aveți posibilitatea să vă adresaţi cu o plângere Autorității Naţionale de Supraveghere a Prelucrării Datelor cu Caracter Personal.

DATE CU CARACTER PERSONAL

CATRE CINE TRANSMITEM DATELE CU CARACTER PERSONAL? In anumite situatii pentru a ne indeplinii obligatiile si sarciniile in bune conditii si in conformitate cu dispozitiile legale datele dumneavoastra pot fi transmise si unor terte persoane care au stricta legatura cu activitatea prestata.
CAT TIMP SUNT STOCATE DATELE CU CARACTER PERSONAL? LCM va prelua si stoca datele cu caracter personal pe intreaga durata contractuala . Dupa expirarea acestei perioade, datele cu caracter personale sunt sterse sau anonimizate cu exceptia acelor date cu caracter personal care fac parte din acte/documente si pentru care legea aplicabila in domeniu impune un termen de arhivare, insa fara a depasi perioada maxima prevazuta de acel termen.
PROTEJAREA DATELOR CU CARACTER PERSONAL. LCM aplica un cadru intern de politici si standarde privind protectia datelor cu caracter personal . Aceste politici si standarde sunt actualizate periodic pentru a corespunde reglementarilor si evolutiei pietei. In conformitate cu dispozitiile legale in vigoare luam masuri tehnice si organizatorice adecvate ( politici,proceduri,securitate etc) tocmai pentru a asigura confidentialitatea si integritatea datelor cu caracter personal precum si pentru a asigura cadrul necesar de prelucrare a acestora .
